1. Acceptance of Terms
By downloading, installing, or using FamilyLoom ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Dharan Chandrahasan, doing business as FamilyLoom ("we," "us," or "our"), based in Berkeley, California.
2. Description of Service
FamilyLoom is a mobile application that provides guided conversation prompts to help families record storytelling sessions. The App facilitates the recording and local storage of audio on your device. FamilyLoom does not provide cloud storage, transcription, or any processing of your recordings at this time.
3. Eligibility
You must be at least 13 years old to use FamilyLoom. If you are under 18, you may only use the App with the involvement and consent of a parent or legal guardian. The App is intended to be operated by an adult facilitator.
4. Your Content
You retain full ownership of all content you create using FamilyLoom, including audio recordings, session data, and any personal information you enter into the App. We do not claim any rights to your content. Your content is stored locally on your device and is not uploaded to or accessible by FamilyLoom.
You are responsible for backing up your own content. Because FamilyLoom stores data only on your device, uninstalling the App or losing your device will result in the loss of your recordings and data unless you have exported them.
5. Recording Consent
You are responsible for obtaining consent from all participants before recording a storytelling session. Many jurisdictions, including California, require the consent of all parties to a recorded conversation. By using the recording feature, you represent that you have obtained appropriate consent from all participants in the session. FamilyLoom is not responsible for any recordings made without proper consent.
6. Acceptable Use
You agree not to use FamilyLoom to:
Record conversations without the knowledge and consent of all participants.
Violate any applicable law, regulation, or third-party right.
Reverse-engineer, decompile, or disassemble the App.
Attempt to interfere with or disrupt the App's functionality.
7. Intellectual Property
The FamilyLoom app, including its design, question content, branding, and code, is the intellectual property of FamilyLoom and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works based on the App without our prior written consent. The guided questions and conversation methodology within the App are proprietary.
8. Disclaimer of Warranties
FamilyLoom is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
We do not guarantee that recordings will be preserved. You are solely responsible for backing up your content. Device failures, software updates, or other circumstances beyond our control may result in data loss.
9. Limitation of Liability
To the maximum extent permitted by applicable law, FamilyLoom and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, recordings, content, profits, or goodwill, arising out of or related to your use of the App, regardless of the theory of liability.
Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App (if any) in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless FamilyLoom and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the App, your content, or your violation of these Terms, including any claims arising from recordings made without proper consent.
11. Changes to the App and Terms
We may update the App and these Terms from time to time. Material changes to these Terms will be communicated through an updated "Last Updated" date and, where feasible, an in-app notification. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
12. Termination
You may stop using FamilyLoom at any time by deleting the App from your device. We reserve the right to discontinue the App at any time. Upon termination, your locally stored data remains on your device until you delete the App.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Alameda County, California. You agree to submit to the personal jurisdiction of these courts.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
